SHIPPING POLICY:

CostaDelMar.com orders can be shipped within the United States and to Canada. You will have the ability to select your preferred shipping method. Orders placed by 1pm EST on business days will usually ship the same day, but please allow 1-2 business days for your order to process before it ships and 3-10 days for delivery. We do our best to ensure timely deliveries, but please note that shipments can occasionally be delayed due to major holidays or unforeseen circumstances. Tracking numbers will be provided for all orders. For shipments to International addresses, please be aware that you are responsible for any shipping and additional duties, taxes, and other related charges customs may charge. Please check with your country's customs office to determine what these additional costs may be.

RETURN POLICY:

The CostaDelMar.com return policy is simple. Within 30 days of receipt of your order, you may return a pair of qualifying Costa Sunglasses or Costa Gear in its original condition with original packaging in new and saleable condition. (Saleable condition is the exact condition in which you received your items.) Returns must be shipped back within 30 days of receiving your items. FINAL SALE items are not eligible for returns. Shipping costs will not be refunded.

Follow these steps to submit a return:

  1. Visit www.costadelmar.com/costa/returns and complete our online return request form.
  2. Print out the pre-paid return label that you will receive through email within 1 business day of your request and attach to the box.
  3. Take your package to your nearest UPS location.
  4. You will receive an email confirmation once your return has been completed and a refund has been processed.
  5. Please allow up to 5 business days for the credit to show on your account.
  6. We do not exchange items, but you may reorder through CostaDelMar.com at this time.

Official Rules

OFFICIAL RULES. NO PURCHASE NECESSARY TO ENTER THE SWEEPSTAKES.

A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

Submitting an entry constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which shall be final and binding on all matters relating to the Sweepstakes.

  1. Sweepstakes Timing: The Costa Email Opt-In Sweepstakes (the “Sweepstakes”) begins 12:00 a.m. ET on April 1, 2020 and ends 11:59 p.m. ET on March 31, 2021 (the “Sweepstakes Period”). The Sweepstakes Period will consist of fifty two (52) separate entry periods (each, an “Entry Period”) that will start at 12:00 a.m. ET on each Wednesday during the Sweepstakes Period and will end at 11:59 p.m. ET on each Tuesday during the Sweepstakes Period with the exception of the last Entry Period that will start at 12:00 a.m. ET on Wednesday, March 24, 2021 and will end at 11:59 p.m. ET on Wednesday, March 31, 2021.
  2. Eligibility: The Sweepstakes is open only to legal U.S. residents who are physically located and residing in the 50 United States the District of Columbia or Puerto Rico, who are 18 years of age or older as of date of entry. Employees of Costa Del Mar, Inc. (the “Sponsor”), its respective parents, subsidiaries, divisions, affiliates, suppliers, distributors, representatives, and advertising, promotional and judging agencies, and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not, defined as those who share the same residence for at least three months a year), are not eligible to participate or win. Void where prohibited by law. All federal, state, and local laws and regulations apply.
  3. How to Enter the Sweepstakes: There is NO PURCHASE NECESSARY to participate in the Sweepstakes. A purchase does not increase your chances of winning. Internet access required. During the Sweepstakes Period, you may access the Sweepstakes on http://www.costadelmar.com (the “Website”). From the Website, select to opt-in to receive emails from Costa and complete the on-screen registration form to be entered into the Sweepstakes. There will also be various other opportunities to opt-in to receive Costa emails (i.e., at events or on other sites, etc.) to earn a Sweepstakes entry throughout the Sweepstakes Period. Your entry must be received by 11:59 p.m. ET on each Tuesday during that Entry Period to be eligible for that Entry Period’s Prize and (as long as you stay opted in) all subsequent Entry Period Prizes, if any. Entries must be received by 11:59 p.m. ET on March 31, 2021 to be eligible for the final Entry Period’s Weekly Prize. If you are opted-in to receive emails from Costa prior to the start of the Sweepstakes, you will automatically be entered into the first Entry Period’s random drawing and all subsequent Entry Periods’ random drawings. Entries will be carried forward for a subsequent drawing, if any. Limit one entry per person regardless of whether you enter the Sweepstakes at the Website or any other way that you opted-in to receive Costa emails or if you were automatically entered by being opted-in previously. If you choose to unsubscribe you will no longer receive emails from the Sponsor, your entry will not carry forward to subsequent drawings, if any after the date that you have unsubscribed. Use of computer programs and other automatic means to enter the Sweepstakes is prohibited and will result in disqualification. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Normal phone/Internet access and data/usage charges imposed by your phone/online service may apply.
  4. Random Drawings: One winner will be selected for each Entry Period during the Sweepstakes Period from among all eligible entries received by the end of each Entry Period. Odds of winning a Weekly Prize depend on the total number of eligible entries received by the end of each Entry Period. Random drawings will be conducted on or about the first business day following the conclusion of each Entry Period during/just after the Sweepstakes Period. Drawings will be conducted by Sponsor, whose decisions are final on all matters relating to the Sweepstakes. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Limit one prize per person/household. Winners are responsible for all applicable federal, state and local taxes and all other costs and expenses associated with their prize not specified herein as being awarded.
  5. Winner Notification: Winners will be notified and have their prize codes/vouchers fulfilled via email. Prize will be sent to the email address provided at the time of entry. Return of any prize/prize notification as undeliverable will result in disqualification and alternate selection [up to a maximum of two (2) alternates for each Weekly Prize]. Winners must redeem their prize by the date indicated by Sponsor.
  6. Prizes and Approximate Retail Value (“ARV”): Weekly Prizes (52- one awarded per Entry Period): A Sponsor-specified pair of Costa Sunglasses (awarded in the form of a code redeemable for a pair of Costa Sunglasses) and a Sponsor-specified $70 voucher to use towards Costa clothing/accessories. The maximum ARV of each Weekly Prize is $369. No transfer, substitution or cash equivalent for any prizes will be permitted, except at the sole discretion of the Sponsor due to unavailability for any reason and, in such circumstance, an alternate prize of equal value will be awarded and the Sponsor’s obligation to the winners will be fulfilled, and no other additional compensation will be provided. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law. All prizes will be awarded provided a sufficient number of eligible entries by the end of each Entry Period have been received.
  7. General Rules: By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the Sponsor. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in connection with Website or the Sweepstakes or by any human error which may occur in the processing of the entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with Website or Sweepstakes. In the event of a dispute as to any entry, the authorized account holder of the account used to register will be deemed to be the entrant. Winners may be required to show proof of being the authorized account holder of the account associated with the entry. If any dispute regarding the identity of an entrant or potential winner cannot be resolved to the Sponsor’s satisfaction, the affected entry will be deemed ineligible. Proof of entering information via Website or any other manner does not constitute proof of delivery or receipt of such information. Sponsor is not responsible for the failure of any email or entry to be received by Sponsor on account of technical problems or congestion on the internet or at any website. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes or Website may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes or Website, then the Sponsor reserves the right at its sole discretion to cancel the Sweepstakes and select each Entry Period’s Prize winners from among all eligible entries received by the end of the applicable Entry Period prior to cancellation. By participating in the Sweepstakes, the entrant agrees that Sponsor, its parents, subsidiaries, affiliated companies, agents, retailers, advertising and Sweepstakes agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents, will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the prize or parts thereof, if applicable or participation in the Sweepstakes or participation in any Sweepstakes or related activity. By entering the Sweepstakes, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents.
  8. Disputes: This Sweepstakes is governed by the laws of the United States and the State of Florida, without respect to conflict of law doctrines. As a condition to participating in this Sweepstakes, entrants submit to exclusive personal jurisdiction in and agree that any dispute shall be brought in the state of Florida and federal courts in Florida and further agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
  9. Privacy Policy: Any personal information supplied by entrant to Sponsor will be subject to its privacy policy posted at www.costadelmar.com. By entering the Sweepstakes, entrant grants Sponsor permission to collect, use and share entrant’s email address and any other personally identifiable information as necessary for the purpose of Sweepstakes administration and Prize fulfillment.
  10. Winners List: For the winners’ names, available after April 15, 2021, send a self-addressed stamped envelope no later than May 30, 2021, to Costa Email Opt-In Sweepstakes Winners, 100 Marcus Drive, Melville, NY 11747.

Sunset Specials Terms

All items in the Sunset Sale are FINAL SALE items and will not be eligible for returns. Limited quantities. While supplies last. Costa’s Limited Warranty is still included on all sunglasses purchased as a final sale item.

#OneCoast Donation Terms

ALL SALES ARE FINAL. Limited quantities. No returns, exchanges, substitutions, or cash equivalent will be offered. Offer may not be combined with additional offers. Not valid with free shipping offers. #OneCoast t-shirts may not be purchased with discounted or free promo cards or coupon codes. Taxes and shipping may apply and will be the responsibility of the purchaser. Costa’s website Terms of Use also apply. Valid for purchases to U.S. shipping/billing addresses only. Fifty Percent of the proceeds from the sale of each #OneCoast Short Sleeve T-Shirt will go directly to the American Red Cross and 50% of the proceeds will go directly to IGFA’s Worldwide Anglers Relief Fund. Purchases can be made from 9/26/17 to 12/31/19, while supplies last. PROMOTIONAL CARDS TERMS & CONDITIONS

The following terms and conditions (the "Agreement") apply to any Promotional Card having an expiration date and given to the recipient for free by Costa Del Mar, Inc. (“Costa”) or through a corporate purchaser (the "Promo Card").

  1. Acceptance of Terms and Conditions: By accepting and retaining the Promo Card or using the Promo Card, you agree to these terms and conditions, as well as future terms and conditions. Costa reserves the right to change the format, elements, and terms and conditions of the Promo Card program at any time without notice. The Promo Card and associated offers are void where prohibited by law. These terms and conditions supersede all prior terms and conditions. Failure to enforce any provisions of these terms and conditions shall not prejudice the right to enforcement at some future time.
  2. Use: The Promo Card is not a credit card or gift card and cannot be used as one. Use of the Promo Card is limited by the discount or amount of funds on the face of the Promo Card. You cannot increase the funds, if any, on the Promo Card. The Promo Card may only be used by customers in the 50 United States and the District of Columbia to make a single purchase directly from Costa. Each Promo Card can only be used once. Costa will only accept one Promo Card per purchase and Promo Cards may not be combined with any other offer. The Promo Card is not valid for previous purchases, repair order purchases, prescription sunglasses, or Costa® Optical. The Promo Card is intended for use as a gift to an individual. Resale or transfer of the Promo Card or use for unauthorized advertising, marketing, sweepstakes, or other promotional purposes is strictly prohibited.
  3. No Resale: Resale of the Promo Cards or use for unauthorized advertising, marketing, sweepstakes, or other promotional purposes is strictly prohibited. Except where required by applicable law, Promo Cards cannot be redeemed for cash or replaced if lost or stolen.
  4. Redemption: Promo Cards can only be redeemed at www.costadelmar.com or by calling 1-855-MY-COSTA. Promo Cards may only be redeemed up to the amount stated on the face of the card.
  5. Governing Law: This Agreement shall be governed and construed in accordance with the laws of the State of Florida without regard to conflicts of laws principles. Any litigation arising out of or in connection with this Agreement shall be heard only by a federal or state court located in Volusia County, Florida. Notwithstanding anything to the contrary contained in this agreement, in no event shall any party be liable to another for special, consequential, indirect, punitive or exemplary damages.
  6. Pricing and Availability: Prices and availability of products are not guaranteed and are subject to change without notice.
  7. Expiration: Please note that the Promo Card has an expiration date, which can be found on the face of the card. The Promo Card will expire at 11:59 PM EST on the applicable expiration date. After expiration, the Promo Card will not be accepted by Costa. Expired Promo Cards are not replaceable or returnable.
  8. Limitation on Liability: Costa is not responsible for loss, theft, or unauthorized use of the Promo Card. You should safeguard the Promo Card as if it were cash. Promo Cards cannot be replaced or reissued if lost or stolen.
  9. Shipping: Free standard shipping applies on qualifying orders only.

RSA CATALINA SWEEPSTAKES Official Rules

  1. SALES SWEEPSTAKES RULES. These are the official rules (“Official Rules”) of the COSTA RSA CATALINA SWEEPSTAKES (the “Sweepstakes”).
  2. ELIGIBILITY. No purchase necessary. Open only to currently employed retail sales associates at Costa Authorized Retailers in the United States. Must be a legal U.S. resident, 18 years of age or older to enter. Sweepstakes is not open to the general public. To enter, submit the Post-tour Exit Survey (“Survey”), complete and submit the contact form. All entries must be received by Costa on or before October 2, 2019. For a second entry, complete all training modules on ExpertVoice prior to October 2, 2019. Employees of Costa or its affiliated companies are not eligible to participate.
  3. SALES SWEEPSTAKES PERIOD. The Sweepstakes commences as of 9:00 a.m. EST July 10, 2019 and will continue through 11:59 p.m. EST on October 2, 2019 (the “Sweepstakes Period”).
  4. PRIZE: Day Trip to Catalina Island to occur on October 23, 2019, including a boat ride to/from Newport Beach, activities on the island, lunch, and dinner.
  5. ENTRY DEADLINE: All entries must be received by Costa by October 2, 2019.
  6. CONDITIONS OF PARTICIPATION/RELEASES: Sweepstakes is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating, entrant(s) agree to be bound by these Official Rules and the decisions of Costa, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that he or she may win, entrant(s) agree to release Costa, its parent, subsidiary, and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Entrant(s) authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Costa disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Costa’s control, corrupt the administration, security or proper play of the Sweepstakes. Costa may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or Costa’s representatives. This Sweepstakes will be governed by the internal laws of the State of Florida. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within Volusia County, Florida.

RSA CATALINA SWEEPSTAKES Official Rules

  1. SALES SWEEPSTAKES RULES. These are the official rules (“Official Rules”) of the COSTA RSA CATALINA SWEEPSTAKES (the “Sweepstakes”).
  2. ELIGIBILITY. No purchase necessary. Open only to currently employed retail sales associates at Costa Authorized Retailers in the United States. Must be a legal U.S. resident, 18 years of age or older to enter. Sweepstakes is not open to the general public. To enter, submit the Post-tour Exit Survey (“Survey”), complete and submit the contact form. All entries must be received by Costa on or before September 27, 2019. For sales associates that do not complete the in-person tour training, complete the CA Mobile Tour training module on Rise 360 prior to September 27, 2019. Employees of Costa or its affiliated companies are not eligible to participate.
  3. SALES SWEEPSTAKES PERIOD. The Sweepstakes commences as of 9:00 a.m. EST July 10, 2019 and will continue through 11:59 p.m. EST on September 27, 2019 (the “Sweepstakes Period”).
  4. PRIZE: Day Trip to Catalina Island to occur on October 14, 2019, including a boat ride to/from Newport Beach, activities on the island, lunch, and dinner.
  5. ENTRY DEADLINE: All entries must be received by Costa by September 27, 2019.
  6. CONDITIONS OF PARTICIPATION/RELEASES: Sweepstakes is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating, entrant(s) agree to be bound by these Official Rules and the decisions of Costa, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that he or she may win, entrant(s) agree to release Costa, its parent, subsidiary, and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Entrant(s) authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Costa disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Costa’s control, corrupt the administration, security or proper play of the Sweepstakes. Costa may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or Costa’s representatives. This Sweepstakes will be governed by the internal laws of the State of Florida. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within Volusia County, Florida.
  7. RANDOM DRAWINGS: Six winners will be selected at random on September 30, 2019. Odds of winning a Prize depend on the total number of eligible entries received. Sponsor’s decisions are final on all matters relating to the Sweepstakes. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Limit one prize per person. Winners are responsible for all applicable federal, state and local taxes and all other costs and expenses associated with their prize not specified herein as being awarded, if applicable.
  8. WINNER NOTIFICATION: Winners will be notified via email. Disclaimer of any prize or notification as undeliverable will result in disqualification and selection of an alternative winner.
  9. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): PRIZES (6 TOTAL PRIZES): The maximum ARV of each Prize is $400. No transfer, substitution, or cash equivalent for any prizes will be permitted, except at the sole discretion of the Sponsor due to unavailability for any reason and, in such circumstance, an alternate prize of equal value will be awarded and the Sponsor’s obligation to the winners will be fulfilled, and no other additional compensation will be provided. Code terms and conditions apply and no returns or exchanges permitted. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law. Prizes are non-transferrable and cannot be substituted.
  10. DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of Florida, without respect to conflict of law doctrines. As a condition to participating in this Sweepstakes, entrants submit to exclusive personal jurisdiction in and agree that any dispute shall be brought in the state of Florida and federal courts in Florida and further agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
  11. PRIVACY POLICY: Any personal information supplied by entrant to Sponsor will be subject to its privacy policy posted at www.costadelmar.com. By entering the Sweepstakes, entrant grants Sponsor permission to collect, use and share entrant’s email address and any other personally identifiable information as necessary for the purpose of Sweepstakes administration and Prize fulfillment.
